ARBITRATION IN LAW
COURSE OBJECTIVESArbitration training aims to teach the knowledge and skills for the fulfillment of the arbitration, and contains basic information, communication skills, negotiation and conflict resolution methods, and other theoretical and practical psychological knowledgethat relates to the conduct of arbitration activities. Lawyers who have five years of professional experience after graduating from law school can attend these courses.COURSE CONTENTIn the Official Gazette No. 28331, 22 June 2012, Arbitration is defined as conflict resolution method by applying systematic techniques for bringing together to the parties in order to discuss and negotiate. It aims to ensure a communication process to enable people to understand each other, and find their own solutions, in a voluntarily manner, with the participation of an impartial and independent third party with specialized training. People who will be arbitrators take a minimum of fourty eight hours as arbitration training;with thirty-six hours of theoretical and twelve hours practical tarining. Six hours of theoretical training consists of basic principles of law (see a), and thirty hours of technical information and the skills required for arbitration (see b). (a)Basic knowledge of law required for Arbitration covers issues such as suitable areas for Arbitration, issues to be considered in the event of resorting Arbitration at stage of legal procedings? , operations to be carried out as a result of Arbitration negotiations, and the regulation of this agreement in the event of the emergence of an agreement and legal property?. (b)Technical information education consists of training for Arbitration, including communication skills and body language, negotiation methods, meeting management, psychology, developmental psychology, personality, behavior disorders, anger management and problem-solving using social psychology, conflict analysis and conflict resolution methods, mediation process, and code of ethics to be followed in Arbitration.Application training includes application monitoring activities and examples of conflict resolution studies that will enable candidates improve their skills in using systematic techniques, both for individuals and groups. In this context, a conflict scenario will be used for educational purposes? Leading to the resolution of disputes using Arbitration, followed by group evaluations under the supervision of instructors.

DISPUTE SETTLEMENT IN LAW
According to the Ministry of Justice Criminal, Dispute Settlement Manual, in our criminal justice system, reconciliation has been made possible by 5271 of the Law of Criminal Procedure Article 253. The objectives of reconciliation in the criminal justice system are the observance of the victim's benefit, the satisfaction of the victim, and , rather than applying criminal sanctions against crime, the elimination of the damage and repair.??? The goal of reconciliation is to solve the conflict between perpetrator and victim after the crime occurred, with attempt of the mediator. The aim of the reconciliation, as a rule, establishment of direct communication between victim and perpetrator of the crime is to make the perpetrators understand the consequences of their actions. Such meetings help victims to overcome the feeling of weakness that the conventional judicial system is forced to overcome. Trained and volunteer mediators can convert the justice system from contentious and punitive process, to the process based on collaboration for helping the parties reach a compromise. Reconciliation lets victims and perpetrators understand their responsibilities in the real sense, and understand the process of reaching a compromise. Through reconciliation, it is believed the losses incurred are eliminated by reintegrating both perpetrators and victims into society. Participation of reconciliation is entirely voluntary for both parties, and the principle of confidentiality is essential in the process. The reconciliation process allows people to solve disputes through the use of effective communication and problem-solving skills rather than fear, repression and punishment environment. Resorting to reconciliation is very useful, especially in disputes in which one of the parties is a child. The juvenile justice system is not always an appropriate process for the resolution of issues relating to children. Besides, the reconciliation process is important education in itself for children. It promotes new methods of expression and the resolution of disputes and the development social and interpersonal negotiation skills. The total duration of the course is 25 hours, 20 of which are devoted to theoretical knowledge and 5 hours to application.
